أكدت وزارة التجارة أهمية الامتثال بضوابط وأحكام نظام الامتياز التجاري «الفرانشايز» ولائحته التنفيذية عند منح أو ممارسة الامتياز التجاري.
أبرز المخالفات
وحذرت الوزارة من أبرز ستة أنواع من المخالفات قد يقع فيها مانح أو صاحب الامتياز أثناء ممارسة أنشطة الامتياز التجاري، تتمثل في عدم قيد اتفاقية الامتياز ووثيقة الإفصاح لدى الوزارة خلال 90 يوماً من تاريخ توقيع الاتفاقية، وعدم تزويد صاحب الامتياز بوثيقة الإفصاح قبل 14 يوماً على الأقل من إبرام الاتفاقية أو من تاريخ دفعه أي مقابل، «أيهما أسبق»، وعدم قيد تعديل اتفاقية الامتياز بتغيير أي من طرفيها أو مدتها، لدى الوزارة خلال 90 يوماً من تاريخ إجرائه، وعدم طلب إلغاء قيد اتفاقية الامتياز خلال 90 يوماً من انتهائها أو انقضائها، أو صدور حكم قضائي ببطلان الاتفاقية أو إنهائها، وعرض أو منح الامتياز قبل ممارسة أعمال الامتياز مدة سنة من قبل شخصين أو منفذي بيع مختلفين على الأقل، وعرض أو منح امتياز فرعي قبل ممارسة أعمال الامتياز في المملكة مدة سنة على الأقل.
وأوضحت الوزارة أنها تستقبل البلاغات إلكترونياً على المخالفات التي نص عليها النظام ولائحته التنفيذية.
The Ministry of Commerce emphasized the importance of complying with the regulations and provisions of the franchise system and its executive regulations when granting or exercising a franchise.
Key Violations
The ministry warned of six main types of violations that a franchisor or franchisee may commit while engaging in franchise activities. These include failing to register the franchise agreement and disclosure document with the ministry within 90 days of signing the agreement, not providing the franchisee with the disclosure document at least 14 days prior to the conclusion of the agreement or from the date of any payment made, "whichever comes first," failing to register any amendments to the franchise agreement regarding any of its parties or duration with the ministry within 90 days of making such changes, not requesting the cancellation of the franchise agreement registration within 90 days of its expiration or termination, or the issuance of a judicial ruling declaring the agreement void or terminated, offering or granting the franchise before engaging in franchise activities for a year by at least two different individuals or sales executors, and offering or granting a sub-franchise before engaging in franchise activities in the Kingdom for at least one year.
The ministry clarified that it receives electronic reports on violations stipulated by the system and its executive regulations.
